Terms of hire contract
Any persons hiring our Tables, Garlands and Backdrop equipment are responsible/liable for any damage
or injuries occurring from or as a result of misuse or reckless use. Persons using do so at their own risk.
These guidelines are for the safety of all persons using the Tables, Garlands and Backdrop equipment
and it is the sole responsibility of the hiree to ensure they are adhered to. Wellington vibrant party inc
limited does not accept responsibility for any damage or injury to anyone using the Tables, Garlands and
Backdrop equipment, however caused.
All our Tables, Garlands and Backdrop equipment are securely fastened with relevant weights,
sandbags/weight bricks. With 2 points of stabilisers. Erected in a safe and stable manner at time of setup.
under no circumstances should you move these.
1. Definitions:
We/Our/us: wellington vibrant party inc limited
You/Your: The person hiring the Tables, Garlands and Backdrop equipment
Tables, Garlands and Backdrop equipment: Tables, Garlands and Backdrop equipment and all
accessories (including candy wall/lollie wall and display shelf) as outline on the Tables, Garlands and
Backdrop equipment Contents and Accessory sheet
2. Charges/Cancellations:
a) The charge for hiring the Tables, Garlands and Backdrop equipment is:
i. Based on a 4 hour(s) period plus $100.00 bond.
ii. $15 per hour for additional hour(s) as per agreed between parties
The charge for securing your hire date is:
i. A 30% upfront deposit of the total hireage amount (referred to as ‘securing date deposit’)
with the remaining balance of hireage cost plus $100.00 bond payable no later than two weeks
(14 days) before the hire commencement date.
iiii. If cancellation of hireage occurs within 14 days of the events commencing date, the booking
total will be held in full with the option of a rescheduled date of hire at an available time, not a
refund.
v. If cancellation of hireage occurs outside of 14 days of the events commencing date, 30%
(which is the securing date deposit) will be held in full with the option of a rescheduled date of hire
at an available time, or a 70% refund. Not a full refund.
b) The bond will be refunded to you once the Tables, Garlands and Backdrop equipment has been
checked to ensure all components are accounted for, clean and undamaged. If multiple items are hired,
(full party setups etc) the greater of the two bond prices will be charged.
3. Condition of Tables, Garlands and Backdrop equipment
You shall be deemed to have inspected the Tables, Garlands and Backdrop equipment and accessories
and to have agreed that it is supplied in good condition. You must advise us of any faults or damage when
coming into possession of theTables, Garlands and Backdrop equipment.
4. Your responsibility
a) You become responsible for the Tables, Garlands and Backdrop equipment when it has been
erected in point of hire premises. Your responsibilities include protecting the Tables, Garlands and
Backdrop equipment and keeping it safe from the weather, theft, vandalism or improper use. Your
responsibility ends once the Tables, Garlands and Backdrop equipment has been deflated and
collected from point of hire premises.
b) You are, during the hire period, responsible for the supervision of theTables, Garlands and
Backdrop equipment, its care, safety from damage, and the behaviour of all persons using the
Tables, Garlands and Backdrop equipment. You shall not sub-hire the Tables, Garlands and
Backdrop equipment
c) You must inform us of the nature of the event for which the Tables, Garlands and Backdrop
equipment is to be used for.
d) You will be responsible for any death, injury, loss or damage caused by the Tables, Garlands and
Backdrop equipment being misused during your hire period.
5. Safety Instructions
You must ensure that everyone who attends events with Wellington vibrant party inc Tables, Garlands and
Backdrop equipment present understands that they shall not climb on, pull, move or go behind the rear of
the backdrop. You must make sure the goods are not misused.
6. Maintaining the Tables, Garlands and Backdrop equipment, and reporting accidents
You must bring to our attention if anything is not operating correctly. you must report this to us
immediately. You must not repair the Tables, Garlands and Backdrop equipment unless you are
authorized by us. You must tell us immediately if the Tables, Garlands and Backdrop equipment is
involved in any accident resulting in damage to the goods or to other property, or injury to any person.
7. Payment for Tables, Garlands and Backdrop equipment that is lost, stolen or damaged
You must pay to us the cost of replacing the Tables, Garlands and Backdrop equipment if it is lost or
stolen or damaged beyond economic repair (that is if the repair would cost more than the Tables,
Garlands and Backdrop equipment is worth).
8. Cancellation due to weather
Wellington vibrant party inc limited allows all our equipment to be set up outdoors on a dry, flat surface.
Wellington vibrant party inc limited recommends having an indoor covered secondary option on the day.
Due to preparation reasons leading up to the said event, Wellington vibrant party inc limited do not offer a
full refund. Alternatively a reschedule date will be offered on an agreed available date or a 30% refund of
the total cost will be returned.
9. Lost, stolen, damaged or unclean Tables, Garlands and Backdrop equipment. You are responsible for
the Tables, Garlands and Backdrop equipment whilst in your possession. Police will be notified in the
event of any theft.
a) No backdrops are to be moved from the erected position in which Wellington vibrant party inc
have placed it.
b) No tables are to be moved from the position in which wellington vibrant party inc have placed it.
c) No red Coloured fizzy stainable liquids on the white tables as these will stain and you may be
liable for cleaning or in extreme cases, replacement costs.
d) You must not allow anyone to enter the rear of the backdrops and or remove any support
stabilizers.
e) No person(s) to be standing on tables.
10. Ending the contract
This contract may be ended by mutual agreement between Wellington Vibrant Party Inc Limited and you
11. Change of location after initial quotation/and or signing of agreement/contract
A change of location fee WILL apply to that of the originally agreed events location.
a) This fee is in accordance with the applicable changes in which the amount will be
addressed on a case by case basis. Wellington Vibrant Party Inc Limited will take all necessary steps to
work with the party(s) to assist with the change, however if a location change causes disruption to any
other confirmed booking/time frames to that of other bookings and/or other events on the same day,
Wellington Vibrant Party Inc Limited has the right of refusal.
b) A 70% refund may be available If location change occurs outside of 14 days, if changes
happen within 14 days of events commencement date and Wellington Vibrant Party Inc refuse due to
booking clashes, a 30% refund of the total amount will be given or an alternative date selection will be
offered.
12. Booking details.
Wellington vibrant party inc Ltd will hold your spot in pencil for 72 hours from the time booking details
have been sent via email. If we have not yet received the securing date deposit within this 72hr period
and/or no payment agreement has been organised between yourself and Wellington vibrant party inc Ltd.
We will then classify your booking as invalid and will reopen availability.
If we do receive the 30% securing date deposit within the 72 hr period. Your specific date and time is
classed as booked as per the agreed details stated on your invoice, content and accessories sheet. With
the remaining balance due 14 days prior to the event's commencement date.
A reminder message will be sent out prior to these 14 days if we have not yet received the balance.
If no contact has been made or future payment plan agreed upon prior to the 14 days commencement
period, we then hold the right to forfeit your booking in accordance with the Contract and Commercial Law
Act 2017 on the subclause, Breach of Contract.
Wellington vibrant party inc Ltd will return 30% of your total securing date deposit to the provided account
as noted on the bond refund form, plus charge a set admin fee of $30.00 + gst
Wellington vibrant party Inc Ltd will act lawfully in accordance with the Contract and Commercial Law Act
2017, s5, (s)191.
13.Late service pickup fee
Any event with a pickup time of or after 1830 will include a $30.00 late pickup fee.
14. Our rights of access
We may enter any land or premises where we reasonably believe the goods are. We can only have this
access if we need to inspect, test, repair, service, replace or repossess the goods. We may do this at
reasonable times and after giving reasonable notice.
